In order to apply to Court for divorce, the Court must be satisfied of two things:
- That the marriage has broken down irretrievably which is satisfied by evidence of separation for 12 months; and
- That there are proper arrangements in place for children, if any.

During a separation, children are particularly vulnerable and can experience extreme stress if parents are unable to resolve conflict. During these times we recommend you see a psychologist or relationships counsellor.
